This End-User Licence Agreement ("EULA") is a legal agreement between you and A.T.A.N Industries, a company registered in England and Wales (company number 17306187), registered office 483 Green Lanes, London, England, N13 4FG ("Licensor", "we", "us") for the Islamix mobile application, including all associated components, updates, and documentation (the "App"). By installing or using the App, you agree to this EULA. If you do not agree, do not install or use the App.
1. Licence grant
We grant you a personal, limited, non-exclusive, non-transferable, non-sub-licensable, revocable licence to download, install, and use the App on any device that you own or control and that you are authorised to use, solely for your own personal, non-commercial purposes, and subject to this EULA and the rules of the app store from which you obtained the App.
2. Restrictions
You may not, except to the extent applicable law expressly permits despite this restriction, or the App's open-source components allow:
- copy (other than as needed for normal use and backup), modify, adapt, translate, or create derivative works of the App;
- reverse engineer, decompile, or disassemble the App, or attempt to derive its source code;
- rent, lease, lend, sell, redistribute, sub-licence, or otherwise commercially exploit the App;
- remove, alter, or obscure any copyright, trademark, or other proprietary notices; or
- use the App in violation of applicable law or the rights of any third party.
3. Ownership
The App is licensed, not sold. We and our licensors retain all right, title, and interest in and to the App, including all intellectual-property rights. You receive only the rights expressly granted in this EULA.
4. Open-source and third-party components
The App includes third-party and open-source software provided under their own licence terms, which are acknowledged in the App's Third-Party Licences notice (islamix.app/licenses). Those components remain governed by their respective licences, which — to the extent required — take precedence over this EULA for those components. Nothing in this EULA limits your rights under, or grants you rights contrary to, any applicable open-source licence.
5. Updates
We may provide updates, upgrades, or patches to the App. This EULA governs any such updates unless they are accompanied by separate terms, in which case those terms apply. Some updates may be required for continued use of the App.
6. No warranty
To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranty of any kind. See the Terms of Service (islamix.app/terms) for the full disclaimer, which is incorporated by reference.
7. Limitation of liability
To the maximum extent permitted by law, our liability under or in connection with this EULA is limited as set out in the Terms of Service, which is incorporated by reference. Nothing excludes liability that cannot be excluded under applicable law.
8. Term and termination
This EULA is effective until terminated. It terminates automatically if you breach it. On termination, you must stop using and delete all copies of the App. Sections 2, 3, 6, 7, and 9 survive termination.
9. App Store and Google Play terms
If you obtained the App from the Apple App Store, you acknowledge and agree that:
1. This EULA is between you and the Licensor only, and not with Apple. Apple is not responsible for the App or its content.
2. Apple has no obligation to provide maintenance or support for the App.
3. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
4. Apple is not responsible for addressing any claims by you or any third party relating to the App, including product-liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection or similar legislation.
5. In the event of any third-party claim that the App or your use of it infringes that third party's intellectual-property rights, the Licensor (not Apple) is responsible for the investigation, defence, settlement, and discharge of such claim.
6. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
7. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service, and this EULA is between you and the Licensor only, not Google.
10. Governing law
This EULA is governed by the laws of England and Wales, subject to any mandatory consumer-protection laws of your country of residence.
